Opposing counsel is given an opportunity to comment and, if they request (or if we do not receive a response), their name(s) is/are not published We would also like to note that on several occasions, after presenting a submission to opposing counsel, we have been advised that a confidentiality agreement was reached regarding the settlement. We have also become involved in a dispute between counsels to whether a disclosure agreement existed - or whether it encompassed this publication. Please note that we will not report on a matter if there is a confidentiality agreement or a dispute as to the existence of such an agreement, etc. This is an informative publication and the editors do not wish to become involved in disputes between counsel as to whether the details of a settlement can be reported or disseminated. But none the less, we are always looking for submission. |
